Property Transactions


There is substantial behind the scenes work involved in any sale or purchase of property, even if everything goes according to plan. Our job is to make this work go as smoothly as possible.
For a purchase, this work typically includes the following:
  • checking your contract.
  • Obtaining a copy of the title to the property, to ensure there are no legal impediments to your ownership; and
  • Obtaining a Land Information Memorandum from the local Council, to ensure that all necessary Resource Consents have been granted, there are no road widening designations or similiar affecting the property and that there are no undesired building restrictions.
  • Negotiating with the seller regarding any problems with the above or any other conditions in the agreement (such as finance or building inspection).
  • Either "confirming" (finalising) the agreement, or cancelling it depending on the outcome of the above.
  • Following confirmation of the agreement:
    • preparing your mortgage documents and explaining them to you.
    • attending to the legal requirements for transfer of ownership to you.
    • checking that rates and other costs are up to date.
    • checking that the purchase price you will pay has been adjusted to account for the sellers share of rates and other costs.
    • carrying out a "guaranteed search" on your property to protect you against any last minute changes to the title.
    • making arrangements with you and the bank for payment of the purchase price.
For a sale, this work typically involves:
  • checking your contract.
  • negotiating with the purchaser regarding any perceived problems
  • Following confirmation of the agreement:
    • arranging for a discharge of your mortgage from your bank.
    • paying and apportioning rates and other apportionable outgoings to ensure appropriate credits are received from the purchaser
    • receiving payment from the other party.
    • repaying your mortgage and transfering the property to the purchaser
